General terms for signing a distance contract between HIK LTD., with address:

Varna, 22A Mladezhka Str., registered under company case 2630 / 1996 of Varna District Court, BULSTAT 103096732, VAT No BG103096732 and a consumer.

The following general terms in their current version as at the time of the conclusion of the contract, referred to hereinafter as general term or the general terms, shall be applied to all disputes arising in connection with and from the signing of distance contracts between a client and HIK LTD. for electronic and other forms of trade.

Contract parties - HIK LTD. as „Supplier” pursuant to the Consumer Protection Act /CPA/, on one side, and client (user), on the other side.

Subject of contract

After winning an auction, organized by HIK LTD. the client places an order for delivery of goods, subject of the auction. HIK LTD. sells and delivers to the client the ordered products. Payment shall be effected by a credit or a debit card, by payment on delivery or by a bank transfer.

Singing a contract:

The contract shall be considered to be signed at the moment when the client accepts the terms and conditions of HIK LTD. regarding the deal and places an order. The client waives any explicit confirmation for acceptance of the order on the party of HIK LTD.
Orders may be placed 24 hours/day via Internet or by phone at +359 888 93 77 13 or +359 52/ 508 508. Upon delivery of the product, subject of the contract, the client shall confirm its delivery and that s/he has received the information under art. 54 of CPA in writing and shall acknowledge her/his agreement with the general terms of HIK LTD. by signing the attached bill of lading.

Price and payment

The client may pay the announced price only in BGN, calculated on the basis of the auction winning price in USD. This is the price at which the auction has closed and shall represent the offer subject to acknowledgement by the Supplier to the Client’s electronic address. The payment may be effected by payment on delivery after receipt of the consignment, by debit or credit card or by a bank transfer. The price offered on the Internet as at the time of the order shall include the price of the article as well as the cost of the insurance and VAT, if due. The client shall also pay the cost of any additional services such a packaging, dispatching and delivery to the specified address. The cost of the additional services shall be notified in the proforma invoice, received at the client’s electronic address.
When payments are executed by a debit or credit card on the Internet or in another manner, the contract shall be considered concluded immediately after the completion of the transaction or after receiving an electronic letter from HIK LTD. or after the acceptance of the order by phone or by another method. When a client paying by credit or debit card submits an offer, such a client should provide an account for refund of the transaction amount, subject to compliance with consumer rights, in accordance with CPA and art. 53 of CPA.

Delivery of products

The delivery is performed by courier to the address, specified by the client at the time of the submission of the order or to the postal office nearest to the client’s address.

Term for delivery

The maximum term for delivery is 30 business days.

Availability of products

If, after an order has been placed, HIK LTD. establishes that the ordered goods are not in stock or cannot be delivered due to some reasons, HIK LTD. may offer goods with equal quality at an equal price or may reject the client’s order.
The offer to substitute the goods or the notification of rejection of the client’s order should be performed as soon as the client’s order has been received. If payment has received for ordered goods, which are not in stock or which cannot be delivered, HIK LTD. shall refund the client who ordered such goods within 30 days from receipt of the order.

Warranty

HIK LTD. warrants that the goods it delivers at customer’s order possess all the qualities, specified in the advertisement on the Internet and it shall be considered that delivery of goods with the same parameters is ordered. Immediately after the receipt of the goods, the consumer should check for non-compliances in accordance with art. 122 of CPA. If there are any non-compliances the consumer should submit a written claim stating the non-compliances according to art. 125 of CPA.

 

If any hidden defects and omissions are disclosed, the consumer should submit a written claim after establishing them within the period according to art. 126 of CPA which commences on the date of receipt of the goods. In case of incomplete delivery HIK LTD. must immediately deliver the missing products. In the remaining cases HIK LTD. shall be entitled either to repair the defect part or to send a new product.

If the repair work or the substitute delivery is dissatisfactory, then the client shall be entitled either to discount of the purchase price or to cancellation of the contract.

The warranty shall not cover defects due to the ordinary wear and tear, the inappropriate use or the overloading of the product by the client as well as due to non-compliance with the operation manual.

The consumer shall be entitled to withdraw from the concluded distance sales contract with HIK LTD. within a period of 7 days according to art. 55 of CPA. This period shall commence on the date the consumer receives the goods and the observation of the deadline shall be subject to its sending back to HIK LTD.

The following conditions must be met to exercise the rights of the consumer according to art. 55 of CPA – the consumer must state in writing his/her wish to cancel the contract and must provide a bank account to receive a refund of the amount paid, the consumer must comply with the general conditions, the manufacturer’s packaging of the goods must be intact, the goods must not have been damaged or used and the transport or other costs of the return of the goods must be paid. The consumer shall be responsible for the consignment and its documentation until its received by the Supplier. If the consumer has returned the goods within the valid term and in compliance with the general conditions HIK LTD. must refund the paid purchase price within 30 days without the costs incurred for additional services.

 

The client shall pay for the delivery of the goods to the point of service. The goods to be returned, any complaints and claims shall be sent to the following address: Bulgaria, 9009 Varna, 22A Mladezhka Str.


Personal data protection

All of your personal data required to enter into and perform a deal shall be treated as strictly confidential and shall be provided only to parties concerned with the delivery.

Legal regulation

The legal and business relations between HIK LTD. and the clients shall be subject to the Bulgarian law.
